Subject: FILCOLS Position Paper on the Proposed Quezon City Book Deposit Ordinance

Dear Honorable City Councilors Medalla and Hererra:

The Filipinas Copyright Licensing Society, Inc. (FILCOLS) requests that the proposed Quezon City Book Deposit Ordinance be amended to exclude the right to photocopy the books of affected publishers for wide distribution in Quezon City.

We agree with Article 19 of the Universal Declaration of Human Rights (UDHR) which state "Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers."

We laud the honorable councilors in their desire to make available books "to the public through city libraries and public elementary and high schools." We appreciate "the tax incentive equivalent to fifteen percent (15%) of the tax imposed under Section 28, Article 12, Chapter IV of the Amended Quezon City Revenue Code."

In exchange of the tax incentive, the proposed Quezon City Book Deposit Ordinance asks QC-based publishers to furnish three (3) copies of their printed books and "to grant the City Library limited authority to photocopy" to ensure adequate availability to all the congressional districts of Quezon City.

We agree that QC-based publishers may donate books to libraries and schools as part of their corporate social responsibility. But the proposed photocopying of books on a massive scale and for wide distribution will affect the business of publishers. Loss in sales for publishers means loss in royalties for authors. Low sales will also affect the livelihood of employees who are mostly residents of Quezon City. The proposed photocopying of these books without proper authorization may violate the rights of authors, especially if the publisher does not have the mandate from the copyright owners.

Article 23.3 of the UDHR state "Everyone who works has the right to just and favorable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection."

Also, Article 27.2 of the UDHR state "Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author."

The authors, as the creators of works, sign a contract with the publishers to assign their rights. Under the Intellectual Property Code of the Philippines (IP Code), the authors' copyright or economic rights are the right of reproduction, transformation, distribution, rental, public display, public performance, and other communication to the public. (RA 8293, Chap. V).

Some authors may assign the right of printing and distribution for a limited period of time and for a limited number of copies. Some authors may assign the transformation of the work to other entities. But not all authors assign their reproduction rights to their publishers.

The Berne Convention, where the Philippines is also a party to, recognize the exclusive right of the author to authorize or prohibit the reproduction of the work "in any manner or form." According to the World Intellectual Property Organization (WIPO) "the right of reproduction is often said to be the cornerstone of copyright."

Admittedly there are limitations or exceptions to the reproduction right of the author, "It shall be a matter for the legislation in the countries of the Union to permit the reproduction of such works in certain special cases, provided that such reproduction does not conflict with the normal exploitation of the work and does not unreasonably prejudice the legitimate interests of the author." (Berne Convention, Article 9.2).

Our own IP Code allowed limitations for "the use made of a work by or under the direction or control of the Government, by the National Library or by educational, scientific or professional institutions where such use is in the public interest and is compatible with fair use." (RA 8293, Chap. VIII, Sec. 184.h).

We believe that public interest is in the hearts and minds of the honorable councilors. But to determine if the use of the work is fair, we should also consider "the effect of the use upon the potential market for or value of the copyrighted work." (RA 8293, Chap. VIII, Sec. 185.d).

The normal exploitation of the work and the legitimate interests of the author are principles adhered to by the WIPO-administered Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement, Article 13) and the WIPO Copyright Treaty (WCT, Article 10). All of which were signed by the Philippines.

As the national reproduction rights organization (RRO), FILCOLS received the mandate from 539 authors, 35 publishers and one book industry association to manage their reproduction rights. FILCOLS was formed in 2008 through the joint efforts of the Book Development Association of the Philippines (BDAP), the Intellectual Property Office of the Philippines (IPOPHL), and the National Book Development Board (NBDB). On the international level, FILCOLS is a member of the Brussels-based International Federation of Reproduction Rights Organizations (IFRRO).

We humbly suggest to the honorable councilors not to rush with the passing of this ordinance but to conduct a multi-sectoral consultation with private and government agencies like the IPOPHL, NBDB, BDAP, Unyon ng mga Manunulat sa Pilipinas (UMPIL), Linangan sa Imahen Retorika at Anyo (LIRA), Kuwentista ng mga Tsikiting (KUTING), Ilustrador ng Kabataan (INK), Cavite Young Writers Association (CYWA), Siyudad ng Antipolo Arts Guild (SINAG), Filipinas Institute of Translation (FIT) and the Freelance Writers Guild of the Philippines (FWGP).

Authors have bodies to feed and families to care for. Their right to a just remuneration for the use of their works is protected by our own law and recognized by international treaties. Let us join the international copyright community in protecting authors and their copyright because the creative works of authors educated and enlightened our minds.

Ako si Beverly W. Siy, manunulat at nakatira sa 128 K-8th St., Kamias, Quezon City. Namamalengke ako sa Nepa Q-mart at pinag-aaral ko ang aking anak sa Cubao. Ako ay 13 years nang solo parent at 13 years na rin akong residente ng Quezon City. Matagal ko nang ikinabubuhay ang pagsusulat, pag-eedit at pagsasalin.

Nais kong ipaalala sa inyo na ang isang libro ay binubuo ng napakaraming component. Ilang halimbawa nito ay ang sumusunod:

Lahat po ito ay protektado ng copyright maliban na lamang iyong mula na sa public domain. Kasama sa copyright ang reproduction right o ang karapatan ng authors na kopyahin o paramihin ang kopya ng kanyang akda. Hindi lahat ng rights na nakapaloob sa copyright ay isinusuko ng authors sa kanilang publisher.

Kaugnay nito, tumututol po ako sa inyong panukala na sapilitang pagdedeposito sa Quezon City Public Library ng tatlong kopya ng bawat aklat ng lahat ng publisher na naka-base sa Quezon City.

Tutol po ako dahil wala pong kikitain ang karamihan sa mga author na naghirap para mabuo ang mga aklat, na hinihingi ninyo nang libre mula sa publishers sa Quezon City. Walang kikitain ang mga author sapagkat hindi kayo magbabayad. Higit sa lahat, ang tax incentive na inaalok ninyo, ay para sa publishers lamang. Paano po naman ang mga author?

Alam naman po natin na iilan lamang ang authors na may kaya. Kapag po ipinasa ninyo
ang panukalang ordinansang ito, inaagawan po ninyo ang mga author, lalong higit ang authors na hikahos, ng kanilang pambili ng kanin, ulam, gamot, pambayad ng bahay, pamasahe at iba pa.

Hindi lamang mga author ang inyong inaagawan ng karapatan na kumita mula sa kanilang akda kundi ang kanilang mga pamilya. Kadalasan, ang copyright ng mga author na yumao na ay napupunta sa kanilang mahal sa buhay, ang mga heir o tagapagmana.

Si Rogelio Sicat na sumulat ng well-anthologized na mga akda ay nanirahan at nagtrabaho sa Quezon City sa napakatagal na panahon. Yumao na siya at ang tagapagmana ng copyright ay ang kanyang maybahay na isa ring manunulat: si Ellen Sicat. Si Ellen Sicat ay taga-Tandang Sora, siya ay nagretiro na dahil matanda na siya upang magtrabaho pa. Mayroon din siyang apo na special child, na nangangailangan ng special medication at special education na may kamahalan. Isa sa inaasahan ni Ellen Sicat ay ang kita mula sa royalty at benta ng mga akda ng kanyang asawa.

Si Genoveva Edroza-Matute ay isa ring well-anthologized na manunulat sa wikang Filipino. Kuwentista siya at ang kanyang asawang si Epifanio Matute. Nang pumanaw ang mag-asawa (na hindi nabiyayaan ng anak), ang copyright ay ipinamana kay Corazon Kabigting, pamangkin ng mga Matute na nakatira sa Cubao, Quezon City. Siya ay senior citizen na rin at wala ring anak o asawa para magbigay ng pinansiyal na tulong para sa kanyang mga pangangailangan. Umaasa rin siya sa kita ng mga akda ng kanyang tiyahin.

Si NVM Gonzales ay isa namang well-anthologized na fictionist sa wikang Ingles. Nang siya ay pumanaw, ang naging tagapagmana ng copyright ay ang kanyang asawang 94 years old na sa kasalukuyan. Nasunugan sila ng bahay ilang taon na ang nakakaraan at ang nilipatan nilang bahay ay hindi pa napapagawa ang bubong dahil sa kakulangan sa pera. Tumutulo ang tubig kapag tag-ulan. Isa sa inaasahan niya at ng kanyang pamilya ay ang kita mula sa mga akda ng kanyang asawa. Bukod dito, itinataguyod din ng pamilya ang NVM Gonzales Foundation upang makatulong sa paglinang ng mga manunulat mula sa hanay ng kabataan.

Si Damiana Eugenio, residente ngayon ng UP Village, Quezon City ay naninirahang mag-isa sa malaki ngunit sira-sira nang bahay. Lubha na rin siyang matanda upang magsulat at magtrabaho pa. Isa sa kanyang inaasahan ay ang kita mula sa di mabilang niyang mga aklat tungkol sa folk literature. Halos lahat ng kanyang aklat ay UP Press ang nag-publish. Kung magiging ordinansa ang inyong panukala, wala siyang kikitain ni singko sa lahat ng libro niya na hihingiin lamang ninyo.

Lahat po ng binanggit ko ay residente ng Quezon City at bahagi ng mga constituent na sinasabi ninyong nais ninyong paglingkuran. Sa inyong panukalang ordinansa, sa paanong paraan ninyo sila matutulungan?

Ang panukala ko ay bilhin na lamang ninyo ang mga aklat mula sa mga publisher. Ang pagbili ninyo ng mga aklat ay makakapagbigay ng kita sa mga awtor at makakatulong nang malaki sa kanilang mga pamilya. Ang pagbili ninyo ng mga aklat ay makakatulong sa mga publisher sa Quezon City na simula’t sapul ay nagbibigay naman ng hanapbuhay sa maraming residente ng Quezon City. Ang pagbili ninyo ng mga aklat ay makakapagpayabong ng book publishing industry ng Pilipinas. Ang pagbili ninyo ng mga aklat ay makakapagparami ng manunulat na Filipino at mga akdang Filipino.

Mas marami kayong matutulungan at mapaglilingkuran sa pagbili ng mga aklat ng kapwa natin Filipino.

UMPIL WILL HOLD IN AUGUST ITS ANNUAL CONVENTION AND THE COLONIAL LITERATURE REVALUATION CONFERENCE FOR TEACHERS

As a significant part of its annual convention, the Unyon ng mga Manunulat sa Pilipinas (UMPIL) will hold the Colonial Literature Revaluation Conference for Teachers on 23-25 August 2012 at the Silangan Hall, Cultural Center of the Philippines, Pasay City.


Guest of honor is National Artist for Literature Virgilio S. Almario.


On 23-24 August (Thurs-Frid), respected scholars will deliver papers on the colonial (Spanish period) literature like the pasyon, awit/korido (metrical romances), komedya, and the proto-novels (Urbana at Felisa, Tandang Bacio Macunat etc.). Each one is assigned a particular literary genre and is expected to give new insights on the subject. Fr. Jose Mario Francisco, S.J. (Ateneo de Manila University) tackles the pasyon, Dr. Nicanor Tiongson (UP Diliman) the komedya, Dr. Edgar Samar (AdMU) the korido “Ibong Adarna”, Prof. Louie Jon Sanchez (AdMU) the awit “Florante at Laura,” Dr. Jason P. Jacobo (AdMU) the epistolary “Urbana at Felisa” and Dr. Jerry C. Respeto (AdMU) the narrative “Tandang Bacio Macunat.”


To further inspire the teachers explore methods of teaching these texts, veteran educators will demo-teach on the poetic and prose forms, namely Prof. Danilo Francisco M. Reyes (AdMU) and Prof. Ferdie Lopez (University of Santo Tomas).


On 27 September, the annual UMPIL members convention features the Writers Forum and and the Gawad Pambansang Alagad ni Balagtas. All the previous recipients of the Gawad are invited to attend this whole-day event.


Writers Chris Millado (drama), Carlos Piocos (poetry), and Eli Guieb (fiction) will be the resource persons for the Writers Forum called “Pakikipagtuos sa Halimaw: Ang Pagharap ng Manunulat sa mga Bagong Anyo ng Kolonyalismo” (Facing the Monster: How Writers Deal With the New Forms of Colonization)


The event is made possible by the support of Cultural Center of the Philippines, the Commission on Higher Education (CHED) and the Department of Education (DepEd).
UMPIL members, teachers, and other interested parties are encouraged to attend the conference as well as the convention.

Philippines and the Madrid Protocol

The IPOPHL will begin accepting applications filed via the Madrid Protocol on 25 July 2012.

The Madrid Protocol is a filing system that facilitates the registration of marks in several countries through a single application filed with the IPOPHL. It simplifies the protection of marks outside the Philippines and reduces the cost of registration. The major trading partners of the Philippines—Japan, United States of America, People’s Republic of China, Singapore, Republic of Korea, Germany—are all members of the Madrid Protocol.

RIZALPABETO by FILCOLS Member and poet Vim Nadera and artist Elmer Borlongan

Featuring works by Zeus Bascon, Francis Commeyne, Fernan Escora, Francisco Guerrero, Jacob Lindo, Lee Paje, Don Salubayba, Carina Santos, Luis Santos, Erik Sausa, Shireen Seno, Louie Talents and Clairelynn Uy

This May, a month before it officially ends, Manila Contemporary attempts to reconstruct this tower by introducing our national hero on more relevant and relatable grounds, as a human being. Without discrediting his achievements, this exhibition intends to create a more rounded perspective of Rizal. Digging through layers upon layers of myth, artists are challenged to depict his nakedness as man. Taking into consideration his insecurities, fears and inclinations, we dive into the raw complexity of his person. To have overcome and used these aspects of his humanity for the greater good, only further intensifies the significant prominence that he has attained.

In the Upstairs Gallery, The Center for Art, New Ventures & Sustainable Development (www.CANVAS.ph) will be exhibiting RIZALPABETO, a unique collaboration between poet and FILCOLS Member Vim Nadera and artist Elmer Borlongan celebrating the life and legacy of Philippine National Hero Jose Rizal.

And as supplement to the show, Manila Contemporary will be hosting a talk by Michael Charleston “Xaoi” Chua of the De la Salle University and the Order of the Knights of Rizal, Sucesos Chapter on his essay “THE FIRST EMO: Simple Life Lessons from The Extraordinary Story of José Rizal” on the 9th of June 2012.

FILCOLS Member Eros Atalia Launches his newest book

FILCOLS member Eros Atalia successfully launched his newest book "It's not that Complicated (Bakit Hindi pa Sasakupin ng mga Alien ang Daigdig sa 2012)! last 19 May 2012 at the Bestsellers, 4F Robinson's Galleria, Ortigas Center, Pasig City.

FILCOLS member Jerry Gracio introduced the author then a series of performances followed.

Edgar Allan Guzman and Luis Alandy performed some parts of the latest book in town. Alandy and Guzman were stars of Ligo na U, Lapit na Me, a movie based on the novel of Atalia. It was the prequel of "It's not that Complicated..."

Celebrity writer and FILCOLS member Ricky Lee also graced the event.

Copies are available at all leading bookstores nationwide. The book is published by Visprint, Inc., the partner of FILCOLS for its IP Made E-Z project.

Vibal, PNU, team up for Tablet Classroom Workshop

Dubbed as the Korea-Philippines Copyright Exchange Night, the program started with congratulatory messages from KCC Chairman Mr. Byonh han-Yu, Korean Ambassador to the Philippines Mr. He min-Lee, National Library of the Philippines Director Atty. Antonio Santos, Ministry of Culture and Tourism Copyright Department Chief Mr. Hyung rae-Cho and Intellectual Property Office of the Philippines Director General Atty. Ricardo Blancaflor.

Prof. Fernando Tanguey of University of Santo Tomas led everyone to pray for the success of KCC in the Philippines. KCC Team Leader Mr. Jang sung-Hwan followed and introduced the functions of the Manila Center of the KCC.

Up next was the introduction about Korea-Philippines advisory organs of KCC. The speakers invited everyone to join the group. It is open to students and professionals specializing in IP and copyright. Corporate membership is also entertained.

Two cultural presentations followed while dinner was being served.

According to Chairman Yu in his message printed in the KCC promotional material: Copyright, which backs up the contents industry in cultural competition, is indisputably a source of national wealth and the hope for the future. KCC is striving continuously to create a better culture for legitimate use of copyrighted materials and help develop the copyright industry with international help from copyright organizations all over the world as a global copyright organization.

The Latest from FILCOLS member ATENEO PRESS

LIGHT, a collection of selected stories by Joy T. Dayrit, edited by
Edna Zapanta Manlapaz, will be launched on Wednesday, May 16, from
4.30 pm, at the Ateneo Library of Women's Writings, beside the Ateneo
Art Gallery, Admu campus. The launch also features the exhibit opening
of Dayrit's paintings, a few of which have been reproduced in the book.

Joy T. Dayrit (1944-2011) published her first stories under the
literary editorship of Nick Joaquin in the Philippines Free Press and
subsequently in the Asia-Philippines Leader. In the late 1960s she ran
an art gallery called PRINT, which started as a small exhibition space
for drawings and prints and evolved into an alternative space for
experimental art until its closure in the early 1970s.

LIGHT gathers 24 of Dayrit's published and unpublished stories by
which, Manlapaz says, "are those Joy herself would wish to be read and
remembered." And because she "finally, happily accepted herself as
simultaneously writer and visual artist," this volume features art
work by Joy on the cover and in each of the sections in the book.

According to Danton Remoto, "[t]he woman in the flux of forming her
self--or her many selves--lies at the heart of many of the stories.
Hemmed in by patriarchy, shaped by her society, she nevertheless tries
to break free." Reflecting on why her stories seem to him so new,
Larry Ypil says it is because they are not just stories: "The irony in
Dayrit?s stories is the irony of fiction itself: that we attempt to
capture life by making it up, through word and image, as we go along."

Rica Bolipata-Santos sees in her writing "the painstaking detail given
to objects that inhabit space so that it does not take flight;
thumbtacks placed on context and setting. Sometimes the detailing is
in dialogue, how evenly measured, its cadence I can imagine she tapped
using her cane. Her characters "became" or were always in the process
"of becoming" --- that obscure moment in between a "before" and
"after" pinned, delineated, figured (in the painterly sense). Like the
way she wrote, loved, and lived, it looked effortless, inevitable, and
yet you knew it came with knowing the deepest pain."

LIGHT will be available at a special price at the launch venue, and

WIPO CAPACITY BUILDING SYMPOSIUM SIDELIGHTS

The symposium on Capacity Building by WIPO (World Intellectual Property Organization) was held on April 24 and 25, 2012 in the IPOPHIL office in Bonifacio Global City.
The symposium was attended by delegates from 18 Asia-Pacific countries. The local participants were from related organizations like the Film Academy, National Library, FILSCAP and FILCOLS, both Collective Management Organizations or CMOs.

FILCOLS @ the Lasallian Schools Press Conference 2012

FILCOLS’ Beverly Siy delivered a talk entitled “Free Flowing Copyright” at the Lasallian Schools Press Conference 2012 last 4 May 2012. It was held at the Lecture Room 0916 De La Salle-College of St. Benilde (DLS-CSB) School of Design and Arts Campus, Pablo Ocampo St., Manila. The theme of the LSPCON 2012 was Creating the Future through Innovative Journalism.

More than fifty college students attended the FILCOLS’ session. They represented various Lasallian institutions in the country, including those in Metro Manila, Antipolo, Cavite and Bacolod. They have different degree programs but they are all involved in the production of their school’s student publications (newspapers, magazines, folios, etc.) According to Prof. Dianne May Torres, the head of the Student Publications Office of DLS-CSB, in Lasallian Schools Press, the copyright stays with the creators even if they are working for the campus papers.

Siy discussed the basics of copyright. She emphasized the need for the members of the audience to know more about their rights and to help their schoolmates know more about intellectual property and copyright. She ended the talk with an invitation for the students to join campus press and authors organizations like FILCOLS.

LSPCON 2012 was organized by the Alliance of Lasallian Campus Journalists and Advisers, Student Publications Office of DLS-CSB and Manila Bulletin. LSPCON 2012 also featured FILCOLS members Eros Atalia who talked about injecting humor into one’s writing, Ronald Lim who was a panellist for the plenary session: The Changing Media Landscape and Ricky Lim who talked about Writing in Filipino for Today’s Audience.

The National Book Development Board (NBDB) presented writing grants for the first time ever from the NBDB Trust Fund to three winning writers. They are Mercedes Planta, Ph.D. for \"Traditional Medicine in Colonial Philippines, 16th to the 19th Centuries\" (health and wellness category); Ma. Florina Orillos-Juan, Ph.D. for \"Kasaysayan at Vulnerabilidad: Ang Kabihasnan at Lipunang Pilipino sa Harap ng Pananalanta ng Balang 1569-1949\" (environment and biodiversity category); and Antonio Enriquez for his novel The Siege of Fort Pilar (novel category, originally written in English/originally written in a regional language and translated to English).
